In 1993, Chicago-based Commonwealth Edison Co. ended over a decade of litigation by agreeing to a settlement regarding its construction of nuclear power plants. This settlement included a $1.34 billion customer refund and a $339 million annual rate reduction, making it the largest utility refund in the nation's history. Lueders, Robertson & Konzen, LLC represented a group of about 20 of Commonwealth Edison's largest industrial customers throughout the ten years of litigation and subsequent precedent-setting appeals, and was instrumental in negotiating the final settlement. The settlement resulted in $65 million in rate reductions and rate refunds for the firm’s clients.
The initial dispute arose over challenges brought by consumer groups regarding Commonwealth Edison's building of three nuclear power plants and its subsequent passing on of construction costs (including overruns) to consumers. Commonwealth Edison was the largest nuclear power utility in the country, and some questioned whether the building of the additional plants was even necessary in the first place. Additional questions over the pros and cons of nuclear power itself lurked behind the larger concern over the enormous cost of building the facilities, an issue which loomed over the course of a decade of hearings before the Illinois Commerce Commission and numerous appeals to Illinois courts.
Although economic and industrial analysts seemed to agree that the power plants did in the end provide efficient fuel generation for the company and its customers, consumer groups achieved a victory by obtaining a record-breaking settlement which sent a clear signal to power companies about the way construction costs should be handled.
